Samsung wins patent case against Apple in Japan

TOKYO: A Tokyo court on Friday dismissed Apple Inc's claim that Samsung had infringed on its patent -- the latest ruling in the global legal battle over smartphones that pits the two technology titans against each other.

Samsung Electronics Co of South Korea, the world's largest maker of phones, welcomed the Tokyo District Court ruling that its technology to synchronize mobile players with computers did not infringe on Apple patents as confirming "our long-held position."

"We will continue to offer highly innovative products to consumers, and continue our contributions toward the mobile industry's development," the company said in a statement.

The Apple lawyer present at the courthouse declined comment, and it was not immediately clear whether Apple would appeal.

In a session lasting a few minutes, Judge Tamotsu Shoji said he did not think Samsung products fell into the realm of Apple technology and dismissed the lawsuit, filed by Apple in August last year.

Apple, the Cupertino, California-based maker of the hit iPhone and iPad, is embroiled in similar legal squabbles around the world over whether Samsung smartphones, which relies on Google Inc.'s Android technology, illegally used Apple designs, ideas or technology.

In one such case, a jury in California ruled last week that Samsung products illegally used such Apple creations as the "bounce-back" feature when a user scrolls to an end image, and the ability to zoom text with a tap of a finger.

The jury awarded Apple $1 billion in damages, and a judge is now evaluating Apple's request to have eight Samsung products pulled from shelves and banned from the U.S. market, including popular Galaxy model smartphones. Samsung's latest hit, Galaxy S3, was not part of the US ruling.

Friday's ruling was the first held in Japan in the Samsung-Apple global court battle, but other technology is being contested by the two companies in separate legal cases in Japan

Apple products are extremely popular among Japanese consumers, but major Japanese carriers such as NTT DoCoMo sell Samsung smartphones as well. Japanese electronics maker Sony Corp also makes smartphones similar to Samsung's, using Android technology.

Samsung has sold more than 50 million Galaxy S and Galaxy S2 smartphones around the world. The legal battle also involves Samsung's Tab device, which Apple claims infringes on patents related to the iPad tablet.

If you're outside the United States, in Britain say, the last time you checked in Mitt Romney was the privileged, hapless candidate born with a silver foot in his mouth who had managed to screw up what should have been the easiest possible assignment ? making nice to London on the eve of the Olympics ? and was surely destined to go down to defeat in November at the hands of that master rhetorician and campaigner, Barack Obama.

If that's your view, you may want to sit down. For Romney and Obama are now locked in a bitingly tight contest, one that the Republican candidate has a good ? and increasing ? prospect of winning. On 7 November there is an even, maybe better than even, chance that the world will wake up to President Romney.

This is not a verdict on Romney's speech here in Florida, formally accepting his party's nomination. That was a bland affair ? even supporters called it "workmanlike" ? which drew a tepid response in the hall. Nor did Romney reveal previously hidden gifts for oratory or suddenly show himself to be a warm, telegenic match for Obama. Instead it is an assessment of the basic political reality, one in which those defects of Romney's might not even matter.

Start with two numbers that are horrible for Obama. The first is his poll rating, which remains stubbornly below 50%. History suggests that incumbent presidents unable to break the 50% barrier at this stage end up serving just one term. The second figure, which goes a long way to explaining the first, is the statistic that puts US unemployment at 8.3%. Joblessness has not stood below 8% since the month Obama took office. Again, the?historical record is brutal on sitting presidents seeking re-election against such a bleak economic backdrop. The last one to pull it off was Franklin Delano Roosevelt in 1936.

Viewed like that, the fact that Obama is even in a statistical dead-heat with Romney nationally is quite an achievement. It has come thanks in part to an aerial bombardment of TV advertising by the Obama campaign in decisive states, consisting mainly of 30-second attacks on Romney, depicting him as a corporate vulture who won't tell the truth about how much tax he pays. That such a heavy assault has only managed to result in stalemate illustrates the gravity of the president's situation.

What's more, a serious Romney counter-attack is on the way. Under the rules of campaign finance, the Republican only gained access to his full war-chest on Thursday night, when he became his party's formal nominee. Unusually for a challenger, he is comprehensively out-fundraising Obama, pulling in more than $200m in June and July alone. Romney is backed too by a series of so-called Super Pacs (political action committees), officially unaffiliated bodies that are able to keep the source of their funds secret and who can spend unlimited amounts on TV commercials. Obama has some Super Pac allies of his own, but here too Romney has the advantage.

The coming phase of the campaign holds further bright possibilities for the Republican candidate. Yes, Obama will get his moment in the sun next week as Democrats gather for their convention in Charlotte. But any momentum could come to an abrupt halt on Friday, when the latest job statistics are published.

October brings three live TV debates between the two men, often landmark moments in a presidential contest. Of course these could go either way. If Romney stumbles so badly that he is deemed an implausible president, his bid will be over. But he is an experienced debater, battle-hardened by bruising primary campaigns this year and in 2008. And debates often help the challenger simply by putting him alongside the president, thereby granting him equal status.

It's true that Romney is a stiff performer and cannot rival the charm and ease of Barack Obama. Likability usually matters a lot in US elections. But this could just be the year when it matters less. The case Republicans presented in Tampa was that the economy needs to be fixed and that Romney is the man to fix it. They point to a CV that shows Romney has succeeded in every task he has undertaken, whether as governor of Massachusetts or salvaging the 2002 Winter Olympics in Salt Lake City. So what if he can't emote and looks permanently awkward? He's a proven turnaround artist and, as his wife, Ann, said on Tuesday: "This man will not fail."

Judged like this, Romney will not have to prove he's likable so much as "acceptable", say some of his senior allies, and that is a much lower bar. Thursday night's testimonials from church members Romney had helped as a Mormon lay pastor ? telling clearly genuine stories of Romney coming to the aid of families faced with tragedy, including sitting with a dying 14-year-old boy who had asked for Romney's help drafting a will ? suggest a way the candidate might clear that bar easily.

Of course, Obama retains?big advantages. Many Americans still like him and think well of him. They believe he has tried his best, having been dealt a tough hand by his predecessor. They credit him with the removal of?America's number one enemy and the?rescue of the country's car industry. As the bumper sticker has it: "Bin Laden's dead and GM's alive."

They still do not know Mitt Romney well and might yet be persuaded that he is a pampered plutocrat whose wife owns "a couple of Cadillacs" and who is out?of touch, whose own?policy reversals over the years ? on?abortion and the like ? suggest a hollowness, a willingness to do or say anything to gain power.

Obama's campaign team is probably the more skilled. The Romney crowd can still mess up: witness the debacle of Clint Eastwood's Dada-ist performance in Tampa, talking to an empty chair. The control-freaks around Obama would have taken no such risk. And the Democrats retain key demographic advantages, favoured by Americans who are black, Hispanic, young or female. The electoral map is helpful too: in the states he has to win, the president is ahead. But that will not matter much if Romney pulls even a couple of percentage points ahead. Al Gore in 2000 apart, winners of the overall popular vote tend to become president.

Put simply, if you thought of Mitt Romney as a joke figure bound to lose in November and soon to be forgotten, think again. This election is knife-edge close ? and, to state what for many around the world will be an unwelcome truth, that means either man could win.

When it comes to online video, presentation matters.

As the technology for handling online video in the corporate sector improves, so too do the expectations of end users looking for a high-quality viewing experience. This is an important factor to keep in mind as more and more companies look to push the frontiers of webcast distribution increasingly to smartphones and tablet devices.

Unfortunately, it?s not just about making the videos themselves look good. Truth be told, converting videos destined for PC distribution into files that could be distributed to and viewed on mobile devices was the industry?s novelty act for 2011. More so than ever before, the portals that package and present this content in the mobile environment matter as well.

Indeed, the next step in the evolution of mobile online video is the development of software that makes it easier for organizations to package and present video content via eye-catching and easy-to-navigate interfaces. For lack of a better term, mobile video is taking its first steps into the age of ?portalization.?

Simply put, the end user experience on a mobile digital device is different than the experience one has accessing online multimedia content via a desktop PC or laptop. As a result, the traditional templates used to package and present video content archives on Web-based computers won?t really address the needs or expectations of would-be viewers in the mobile environment.

Corporate decision makers considering the deployment of new online video technology solutions must keep the issue of mobile presentation in mind. While most vendors today can rightfully boast about their ability to enable online video distribution in mobile environments, the devil is in the details.? Some are already optimizing the mobile experience, while others lag.

Ask tough questions of would-be technology partners about their mobile offerings. Specifically, find out how links to videos will be presented on mobile devices. Will end users have to scroll through a series of text-based links to find what they need? Or will they be able to employ touch-and-slide navigation through a series of video thumbnails that provide a description summary of the content?

The answers to these questions will go a long way in determining the quality of your audience?s experience when accessing your organization?s content online via mobile devices. Certainly, not every executive will be demanding to see slick iOS-style applications enabling eye-catching portals on mobile-devices. But many will.

Corporate decision makers must think long-and-hard about the relative importance of creating engaging interfaces for mobile video distribution and then keep these preferences in mind in selecting a video technology platform for their organizations. When it comes to packaging and presenting videos for mobile environments, not all solutions are created equal.

Editor: Judge 'throws the book' at UK media

LONDON (AP) ? The editor of a U.K. newspaper says he fears that the senior judge tasked with investigating Britain's scandal-tarred press is preparing to deliver a scathing indictment of the industry.

The Independent's Chris Blackhurst told BBC radio that documents he'd recently received from Lord Justice Brian Leveson were so harshly worded he was shocked.

Leveson was charged with investigating Britain's media in the wake of the phone hacking scandal, which exposed widespread illegal behavior across the industry.

The judge has promised to give confidential warnings to anyone he might criticize in his final report. Leveson's recommendations aren't binding but will likely have a major impact on Britain's media landscape.

No date is set for the report's release, but Blackhurst said Wednesday the warning he'd seen "throws the book at the industry."

Canon EOS Rebel T4i

The Canon EOS Rebel T4i ($849 list, body only)??is the successor to the Rebel T3i , a camera that suffered from very slow autofocus in Live View mode. The T4i does a much better job, especially when used with Canon's latest STM lenses. It's not without its flaws, the most glaring of which is the small pentamirror optical viewfinder. The 18-megapixel shooter doesn't manage to oust the Nikon D5100 ?as our Editors' Choice for digital SLRs under $1,000, but it may be better camera if you're more focused on video performance.

Design and Features
About standard when compared to other D-SLRs in its class, the T4i measures 3.9 by 5.2 by 3.1 inches and weighs 1.1 pounds without a lens. Even though the competing Pentax K-30??is a smidge smaller at 3.8 by 5.1 by 2.8 inches, it's heavier at 1.4 pounds. This is due in part to its solid glass pentaprism viewfinder, which is larger and brighter than the pentamirror found in the T4i. If you're used to using the rear LCD of a point-and-shoot to frame the size of the viewfinder it may not bother you, but users who are accustomed to the large finders in older 35mm SLRs will likely find it lacking.

Experienced shooters demand a camera that provides easy access to shooting settings. The camera's Mode Dial, which sits next to its power switch, gives you access to a number of scene modes, which configure the camera to shoot sports, landscapes, and macro images, among others. The dial also lets you use Automatic, Program, Aperture Priority, Shutter Priority, and Manual shooting modes.?The T4i's control layout works, although it does feature only one control dial. You'll need to move up to the EOS 60D ?to get dual dials; the Pentax K-30 is one of the few mid-range SLRs with two control dials. There are control buttons to adjust ISO, White Balance, the Drive mode, Exposure Compensation, Autofocus mode, Exposure Lock, and Autofocus Point.

There's also a Q button, which allows you to adjust many of the same settings, along with the Metering mode, from the rear LCD. You can use the physical controls to navigate, or touch the screen to change settings. The display itself is extremely sharp and bright, thanks to a 1,040k-dot resolution. It's housed on an articulating arm, so you can view it from above, behind, or face it forward for self portraits.

(AP) ? Isaac was on the verge of becoming a full-blown hurricane Tuesday as it rolled over the Gulf of Mexico toward Louisiana, where residents of the low-lying coast left boarded-up homes for inland shelter while people in New Orleans waited behind levees fortified after Katrina.

Forecasters predicted the tropical storm would power up to hurricane strength, which starts at winds of 74 mph, later in the day and be at least a Category 1 hurricane by the time it's expected to reach the swampy coast of southeast Louisiana early Wednesday. The forecast track has the storm aimed at New Orleans, but hurricane warnings extended across 280 miles from Morgan City, La., to the Florida-Alabama state line. It could become the first hurricane to hit the Gulf Coast since 2008.

Early Tuesday, Isaac was a large and potent tropical storm packing top sustained winds of 70 mph. The storm system was centered about 125 miles southeast of the mouth of the Mississippi River at 5 a.m. EDT and moving northwest at 12 mph, according to the National Hurricane Center in Miami.

Although Isaac's approach on the eve of the Katrina anniversary invited obvious comparisons, the storm is nowhere near as powerful as Katrina was when it struck on Aug. 29, 2005. Katrina at one point reached Category 5 status with winds of more than 157 mph, and made landfall as a Category 3 storm.

Still, forecasters at the National Hurricane Center warned that Isaac, especially if it strikes at high tide, could cause storm surges of up to 12 feet along the low-lying coasts of southeast Louisiana and Mississippi and up to 6 feet as far away as the Florida Panhandle.

Threatened locales include Houma, a city southwest of New Orleans, where people filled up a municipal auditorium-turned shelter.

Simon and Crystal Naquin decided to bring their teenage sons to the shelter because they were afraid the camper they call home might flood, situated as it is between a navigation canal and lower Bayou Caillou.

Simon Naquin said he rode out hurricanes when he was younger, but doesn't do that anymore since seeing the damage wrought by hurricanes Andrew, Katrina and Rita.

"Now that I got kids, I've seen too much to say, 'Stay,'" said Naquin, who shared a twin air mattress with his wife while their sons read and snacked on jambalaya amid a pile of blankets and next to a stash of water bottles and food.

Not far from the subdued atmosphere of the shelter, the lights were low and the music loud at Sue Sue's on the Bayou Sports Bar, owned by the husband-and-wife team of Sonny Diehl, 63, and Sue Diehl, 62.

The couple moved to Houma after they rode out Katrina at a New Orleans hotel.

"I think we take it more seriously down here," Sue Diehl said. "And everybody prepares. They get together, they help each other. It's a great community."

"Everybody helps everybody," Sonny said. "Not so much in New Orleans."

In New Orleans, Mayor Mitch Landrieu did not activate a mandatory evacuation Monday. Instead, officials urged residents to hunker down and make do with the supplies they had.

Federal officials said the updated levees around New Orleans are equipped to handle storms stronger than Isaac.

But with landfall expected Wednesday, Katrina's seventh anniversary, anxiety was high, especially in the Lower 9th Ward, wiped out by Katrina after floodwalls burst and let the waters rush in.

"I don't really trust the levees," said Robert Washington, who planned to evacuate along with his wife and five children. "I don't want to take that chance. I saw how it looked after Katrina back here."

He leaned over the banister of his porch railing and looked out onto empty lots where houses stood before Katrina. His neighborhood, just a few blocks away from where the floodwall protecting the Lower 9th Ward broke open, remains largely empty.

A few streets over, Arthur Smith was unpacking supplies from his car and taking them into his renovated house.

"We have the lamp oil, the water, non-perishable food items, the radio that works without a battery," he said, listing some items on his checklist.

He was planning to either evacuate or hunker down with his 76-year-old mother and sister. He said that decision would be made Tuesday morning once Isaac's forecast became better defined.

The blanket of sea ice floating on the Arctic Ocean melted to its lowest extent ever recorded since satellites began measuring it in 1979, according to the University of Colorado Boulder's National Snow and Ice Data Center.

On Aug. 26, the Arctic sea ice extent fell to 1.58 million square miles, or 4.10 million square kilometers. The number is 27,000 square miles, or 70,000 square kilometers below the record low daily sea ice extent set Sept. 18, 2007. Since the summer Arctic sea ice minimum normally does not occur until the melt season ends in mid- to-late September, the CU-Boulder research team expects the sea ice extent to continue to dwindle for the next two or three weeks, said Walt Meier, an NSID scientist.

"It's a little surprising to see the 2012 Arctic sea ice extent in August dip below the record low 2007 sea ice extent in September," he said. "It's likely we are going to surpass the record decline by a fair amount this year by the time all is said and done."

On Sept. 18, 2007, the September minimum extent of Arctic sea ice shattered all satellite records, reaching a five-day running average of 1.61 million square miles, or 4.17 million square kilometers. Compared to the long-term minimum average from 1979 to 2000, the 2007 minimum extent was lower by about a million square miles -- an area about the same as Alaska and Texas combined, or 10 United Kingdoms.

While a large Arctic storm in early August appears to have helped to break up some of the 2012 sea ice and helped it to melt more quickly, the decline seen in in recent years is well outside the range of natural climate variability, said Meier. Most scientists believe the shrinking Arctic sea ice is tied to warming temperatures caused by an increase in human-produced greenhouse gases pumped into Earth's atmosphere.

CU-Boulder researchers say the old, thick multi-year ice that used to dominate the Arctic region has been replaced by young, thin ice that has survived only one or two melt seasons -- ice which now makes up about 80 percent of the ice cover. Since 1979, the September Arctic sea ice extent has declined by 12 percent per decade.

The record-breaking Arctic sea ice extent in 2012 moves the 2011 sea ice extent minimum from the second to the third lowest spot on record, behind 2007. Meier and his CU-Boulder colleagues say they believe the Arctic may be ice-free in the summers within the next several decades.

"The years from 2007 to 2012 are the six lowest years in terms of Arctic sea ice extent in the satellite record," said Meier. "In the big picture, 2012 is just another year in the sequence of declining sea ice. We have been seeing a trend toward decreasing minimum Arctic sea ice extents for the past 34 years, and there's no reason to believe this trend will change."

The Arctic sea ice extent as measured by scientists is the total area of all Arctic regions where ice covers at least 15 percent of the ocean surface, said Meier.

Scientists say Arctic sea ice is important because it keeps the polar region cold and helps moderate global climate -- some have dubbed it "Earth's air conditioner." While the bright surface of Arctic sea ice reflects up to 80 percent of the sunlight back to space, the increasing amounts of open ocean there -- which absorb about 90 percent of the sunlight striking the Arctic -- have created a positive feedback effect, causing the ocean to heat up and contribute to increased sea ice melt.

Earlier this year, a national research team led by CU embarked on a two-year effort to better understand the impacts of environmental factors associated with the continuing decline of sea ice in the Arctic Ocean. The $3 million, NASA-funded project led by Research Professor James Maslanik of aerospace engineering sciences includes tools ranging from unmanned aircraft and satellites to ocean buoys in order to understand the characteristics and changes in Arctic sea ice, including the Beaufort Sea and Canada Basin that are experiencing record warming and decreased sea ice extent.

Before Star Wars Episode I: The Phantom Menace came back to the theaters earlier this year converted for 3D, the plan was to bring the other five movies to theaters one at a time each year, but that has apparently changed. At the Star Wars Celebration VI event in Orlando (where we first found out about the Blu-ray release two years ago) Lucasfilm announced that Episodes II and III in 3D will be released in theaters back to back in fall of 2013, arriving September 20th and October 11th, respectively. Missing so far from the announcement? A reason for the back-to-back release or any word on Blu-ray 3D plans. In lieu of more details, although it means Attack of the Clones will come back later in the year than Phantom Menace did, with any luck this accelerated schedule is a good omen for the original trilogy's return. Of course, we'll have to wait and see what magic can be worked with those older film and special effects elements, however IGN apparently found an early preview of the Episode II 3D footage to be promising.

Twin Iraq blasts target prayers

BAGHDAD (Reuters) - Twin blasts in Baghdad on Friday, one exploding beside a pulpit during prayers, killed at least three people and wounded six, a Reuters witness and police sources said.

The attacks are the latest in a wave of violence that underline Iraq's struggle to overcome a stubborn insurgency eight months after U.S. troops left.

The first bomb detonated beside the pulpit, while a preacher was leading prayers at an outdoor mosque in the mainly-Shi'ite Sadr City neighborhood. Moments later, a second device, that had been hidden under weeds amid the worshippers, exploded.

"When the explosions happened, the worshippers stood up, but (the preacher) talked to us, asking us to stay in our places and keep quiet," Abu Ahmed, a 34-year-old worshipper, told Reuters at the scene.

Iraq's local al Qaeda wing has claimed attacks on Shi'ite neighborhoods and security forces as a revival of its campaign to provoke the Sunni-versus-Shi'ite sectarian violence that drove the country close to civil war four years ago.

Heightened tension between Shi'ites, Sunnis and Kurds in the coalition government since U.S. troops withdrew has raised fears of a return to sectarian violence of the kind that pushed Iraq to the brink of civil war a few years ago.

(AP) ? The constitutional ban on same-sex marriage in the host state of the Democratic National Convention has stirred anger and resentment among advocates for marriage equality, many of whom are converging on Charlotte this weekend for the city's gay pride festival.

Organizers say they hope the festival will draw attention to the issue and create momentum that lasts through the political convention that starts the following week. Some of the thousands of protesters expected at the convention will be demonstrating for gay marriage.

"We're excited that the convention is in Charlotte," said David Webb, one of the pride festival's organizers. "But we also want to show that we're united and will continue to push for change."

When North Carolina voters passed the constitutional amendment in May, supporters of gay marriage first demanded that Democrats rethink Charlotte as the location of their convention. But advocates have since seized on the party gathering as a high-profile chance to make their message heard ? with support from the party itself. The national party is expected to approve marriage equality as part of its national platform during the convention being held from Sept. 4-6.

For the first two days, the Time Warner Cable Arena in Charlotte's downtown will be the main venue. On the last day, President Barack Obama will make his acceptance speech at the 74,000-seat outdoor Bank of America Stadium where the city's NFL team plays.

Webb said public events like the festival and convention are important opportunities to rally same-sex couples who were discouraged by the North Carolina vote.

"It's an opportunity for the community to say, 'Yes. The state may have passed an amendment limiting our liberties, but we're going to keep fighting.' This is an opportunity to show the community and ourselves that, you know what, we're not down and out," he said.

When the Democratic Party picked Charlotte to host the convention, the proposal to change North Carolina's constitution was not on the ballot. Like so many states, same-sex marriage already was illegal in North Carolina.

Voters approved the amendment declaring that marriage between a man and woman is the only legal domestic union, prompting angry supporters of same-sex marriage to urge Democrats to move the convention. President Barack Obama stated his support for gay marriage a day after the North Carolina vote.

Democrats have been trying to address the issue. The national Democratic Party's platform committee recently endorsed gay marriage for the first time and called for the repeal of a federal law that recognizes marriage as between a man and a woman.

The platform is a broad statement of the party's priorities on the economy, social issues and national defense that's up for approval at the convention.

Scott Dibble, a committee member and a state senator from Minnesota, said support for gay marriage can attract new voters.

"Young people are looking for a political home right now. This has become a defining moral question of our time," said Dibble, who is gay.

The platform says Democrats support "marriage equality" and the "movement to secure equal treatment under law for same-sex couples."

J. Michael Bitzer, a political science and history professor at Catawba College, said Democrats can use the North Carolina vote as "rallying cry for their platform."

"But I think it kinds of sets up an awkwardness that the national Democrats will ratify or solidify their support for marriage equality in a state that recently banned gay marriage," he said

The convention creates an opportunity for more dialogue about same-sex marriage, said the Rev. Jasmine Beach-Ferrar, executive director of the Campaign for Southern Equality. Her group has been organizing the "We Do" campaign which advocates for lesbian, gay, bisexual and transgender people.

"This convention is a way to highlight some of these contentious issues because North Carolina helps illustrates what's going on. It's good to remind people what's going on here," Beach-Ferrar said.

She said it's an important issue. Same-sex couples don't have the same rights as married couples. That complicates issues such as benefits and adoption.

"For me, there's clearly a real urgency on the issue. And I'm eager for us to move beyond the very predictable polarized debate and actually start talking about how real people are being impacted by discriminatory laws and what the solution is," she said.
